1. About Parkingnb & Marketplace Scope

Parkingnb (“Parkingnb”, “we”, “us”, or “our”) operates the website at parkingnb.com and the Parkingnb mobile applications. We provide a peer-to-peer technology platform and marketplace that connects independent parking space owners or authorized tenants (“hosts”) with drivers seeking verified parking spaces (“guests”) in Dubai, United Arab Emirates.

Important Disclaimer: Parkingnb is an independent technology marketplace. Parkingnb is not affiliated with, endorsed by, or operated by the Dubai Roads and Transport Authority (RTA), Parkin PJSC, Parkonic, the Government of Dubai, or any other government or municipal entity.

2. Acceptance of Terms & Eligibility

By creating an account, accessing our website, or using our mobile applications, you enter into a legally binding agreement with Parkingnb and agree to adhere strictly to these Terms of Service and our Privacy Policy.

You must be at least 18 years of age and possess the legal capacity under UAE law to enter into binding contracts. By registering, you warrant that all information provided during signup and identity verification is accurate, complete, and current.

3. Host Representations & Warranties

Each host creating a listing on Parkingnb warrants and agrees that:

They hold valid legal authority, title deed ownership, or explicit tenancy agreement permission (including any necessary landlord or building management NOC) to grant parking access to third parties.
The listing accurately depicts the bay location, parking bay dimensions, clearance height, gate access method, and any building rules.
The assigned parking space is vacant, clean, safe, and unobstructed for the entire duration of any confirmed reservation.
They will not double-book, block, or interfere with a guest's lawful occupancy during a confirmed rental period.

4. Guest Responsibilities & Parking Conduct

Each guest booking a space through Parkingnb warrants and agrees that:

They will park only the specific vehicle with the license plate registered on the booking confirmation, strictly within the boundary markings of the designated parking bay.
They will comply with all posted building speed limits, security instructions, and community association rules.
They will not store hazardous materials, flammable fluids, non-operational vehicles, or commercial freight in the space.
They will not perform mechanical repairs, oil changes, or washing inside private residential garages unless explicitly authorized.
They will vacate the parking space immediately upon the expiration of the confirmed booking period.

5. Access Devices, Fobs & Key Card Transfers

Where parking access requires physical RFID transponders, barrier key fobs, or access cards:

Host and guest shall coordinate the safe handover of access devices prior to check-in, using the built-in messaging facility.
The guest must inspect and verify the access device upon receipt and promptly report any malfunction within 2 hours.
The guest is strictly prohibited from duplicating, cloning, or transferring any physical access card or fob to unauthorized third parties.
The guest must return all access devices in good working condition upon checkout. If an access device is lost, stolen, or damaged, the host is entitled to deduct the actual replacement cost plus standard building administration fees directly from the guest's security deposit held in escrow.

6. Refundable Escrow Deposit Protection

To safeguard both hosts and guests, Parkingnb operates a secure escrow system for security deposits:

Escrow Custody: Security deposits collected at checkout are held in a segregated escrow custody account managed by Parkingnb. Deposit funds are never transferred to the host upfront.
Automatic Release: Upon completion of the reservation, the security deposit is automatically refunded to the guest's original payment method within 48 hours, provided no unresolved dispute, overstay, or access device loss is submitted by the host.
Dispute Resolution: If a host submits a damage or unreturned access device claim, Parkingnb Trust & Safety holds the contested deposit amount until evidence (photos, receipts, building security logs) is reviewed.

7. Bookings, Payments & Physical Real-World Services

Parkingnb facilitates reservations for physical, real-world parking bays and spaces located in Dubai, UAE.

Physical Utility: All payments processed through Parkingnb are strictly for the real-world utility, occupancy, and physical access to assigned parking bays and access hardware. Parkingnb does not sell digital goods, in-app digital currencies, or virtual media.
Payment Processing: Payments are securely processed via certified, PCI-DSS compliant third-party gateways (e.g., Stripe). Guests authorize charges for rental fees, applicable escrow deposits, and platform service fees upon booking confirmation.
Host Payouts: Host earnings are disbursed to verified UAE bank accounts in accordance with our standard payout schedule, minus applicable platform service fees.

8. Cancellations, Refunds & Booking Extensions

Our standardized cancellation policy ensures predictability for all members:

Prior to Host Acceptance: Guests may cancel pending booking requests at any time before host confirmation with 100% refund and zero cancellation fees.
Free Cancellation Window: Guests can cancel confirmed bookings up to 7 calendar days prior to the scheduled check-in date for a full 100% refund of rental fees and security deposits.
Late Cancellations: Cancellations made within 7 days of the scheduled check-in are subject to a partial cancellation fee (equivalent to up to 7 days of rental) to compensate the host for reserved capacity.
Host-Initiated Cancellation: If a host cancels a confirmed reservation or fails to provide access on day one, the guest receives an immediate 100% refund or free transfer to an equivalent nearby bay under our Access Guarantee.
Extensions: Guests wishing to extend a booking must request an extension through the platform at least 48 hours prior to check-out, subject to host approval and space availability.

9. Overstay, Unauthorized Parking & Towing Authorization

Guests must vacate the parking space promptly at the conclusion of their reservation period.

Overstay Charges: An overstaying vehicle is subject to daily unauthorized occupancy fees at 150% of the standard daily rate, plus any administrative and security expenses incurred.
Towing & Impounding Rights: If a vehicle remains in a parking bay more than 24 hours past booking expiry without host consent, the host and building management reserve the right to have the vehicle towed and impounded in accordance with Dubai Police and municipal regulations. The guest assumes sole responsibility for all towing, impoundment, and recovery costs.

10. User-Generated Content & In-App Communications

Parkingnb provides interactive features that allow users to upload, post, and exchange content, including parking space listings, photographs, descriptions, ratings, reviews, and in-app chat messages (collectively, “User-Generated Content” or “UGC”).

Zero-Tolerance Policy on Objectionable Content & Abusive Conduct

Parkingnb maintains a strict, zero-tolerance policy regarding any objectionable content or abusive users. You expressly agree not to transmit, upload, or post any content that:

Is unlawful, defamatory, libelous, harassing, threatening, abusive, or harmful;
Promotes discrimination, bigotry, racism, hatred, or violence against any group or individual;
Is obscene, pornographic, sexually explicit, indecent, or excessively violent;
Contains spam, commercial solicitations, chain letters, fraud, or phishing;
Infringes on any third party's copyright, trademark, trade secret, or privacy rights;
Harasses, stalks, intimidates, or causes distress to other users, hosts, or guests.

Content Moderation, In-App Reporting & Blocking

To maintain a safe community, Parkingnb implements automated and human-reviewed moderation mechanisms:

In-App Reporting: Users can immediately flag or report any listing, review, message, or user directly inside the mobile application or website using the built-in report feature, or by contacting our Trust & Safety team at support@parkingnb.com. All reported content is reviewed within 24 hours.
In-App User Blocking: Users have the ability to instantly block any abusive or unwanted user within the messaging feature, preventing that user from sending messages or interacting further.
Immediate Removal & Account Termination: Any user found to be in violation of our content standards will have their content removed immediately and may face permanent suspension or termination of their account without prior notice or refund.

11. Limitation of Liability

Parkingnb provides a technology platform connecting independent private parties. To the maximum extent permitted by applicable UAE law:

Parkingnb is not an insurer, bailee, security provider, or owner of parking spaces. Parkingnb exercises no direct physical custody or control over vehicles, parking bays, or access transponders.
Parkingnb shall not be liable for any direct, indirect, incidental, punitive, or consequential damages, including loss of profits, vehicle damage, property theft, towing expenses, or personal injury arising from the use of spaces arranged via the platform.
In all events, Parkingnb's aggregate liability arising out of or related to these terms or platform usage shall be limited strictly to the total platform service fees actually retained by Parkingnb for the specific booking giving rise to liability during the three (3) months preceding the incident.

12. Indemnification

You agree to defend, indemnify, and hold harmless Parkingnb, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your violation of any third-party right, building bylaws, or tenancy agreements; or (c) your vehicle's presence in or operation on private premises.

13. Governing Law & Dispute Resolution

These Terms of Service and any non-contractual obligations arising out of them shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the applicable Federal Laws of the United Arab Emirates.

In the event of any dispute, the parties agree first to attempt amicable resolution via the Parkingnb Trust & Safety mediation process. If unresolved within 30 days, the dispute shall fall under the exclusive jurisdiction of the competent courts of Dubai or the Small Claims Tribunal of the Dubai International Financial Centre (DIFC).

14. Changes to These Terms

We may modify these Terms of Service periodically. We will provide advance notice of material changes by posting the updated terms on this page with a revised effective date and notifying active users via in-app message or email. Continued use of Parkingnb after such updates constitutes your binding acceptance.
